HILLTOWNS — The two Hilltown men charged with attempted murder following an Aug. 10 on-the-road shooting have not yet had their case go before a grand jury, Sheriff Craig Apple told The Enterprise on Tuesday.
Lane J. Stannard of Berne and Joel M. Keeny of Medusa, both 24, were each charged with two felonies — second-degree attempted murder and fourth-degree conspiracy — as well as with a misdemeanor: fourth-degree criminal possession of a weapon.
Apple had said earlier that they intentionally opened fire with a .223 caliber rifle, with multiple rounds hitting the victim’s truck and one hitting her arm.
Asked why the men had the same charges if one was shooting and the other driving, Apple said, “It doesn’t matter. They both took part.”
The hope is that “sooner or later” one of them will be forthcoming about the specifics in which case the charges would change.
Asked about the motivation for the shooting, Apple said Stannard and Keeny had been “texting back and forth” with the victim’s son, making threats. The son reached out to his mother.
She went out of her Sickle Road Hill home in Berne, following Stannard and Keeny to try to see their license plate.
Apple said he did not want to “get into the weeds” over the subject of the disagreement.
One bullet narrowly missed the woman by passing through the headrest, Apple said earlier; she received treatment in the early morning hours at Albany Medical Center and was discharged the same day.
Keeny and Stannard had fled the scene but were located by sheriff’s investigators and taken into custody. Their vehicle was found in Massachusetts.
They were arraigned in Rensselaerville Town Court on Aug. 10, the same day as the shooting.
