Sealed bids for the purchase by the Fort Hunter Fire District of a Heavy Duty Rescue incorporating other miscellaneous apparatus will be received at the Fort Hunter Fire House, 3525 Carman Road, Schenectady, NY 12303 until 7:00 PM April 9th 2018, at which time the bids for the vehicle will be publically read aloud.

LOCAL LAW NO. 1 OF THE YEAR 2018

To establish minimum attendance requirements for the Planning Board and Zoning Board of Appeals

SECTION 1. Minimum attendance requirements for the Planning Board and Zoning Board of Appeals. The Town Board of the Town of Knox finds that attendance of Zoning Board of Appeals and Planning Board members at public meetings is essential to the orderly performance of their functions, and it is the purpose of this article to establish minimum attendance requirements for Zoning Board of Appeals and Planning Board members to attend public meetings as set forth herein.

SECTION 2. Authority. In accordance with (i) Section 10 of the Municipal Home Rule Law to adopt and amend local laws not inconsistent with the provisions of the New York State Constitution or not inconsistent with any general law relating to its property, affairs, government, and pursuant to New York Town Law§ 271(9) and§ 267(9), which authorizes the Town to adopt and amend local laws relating to the establishment of minimum attendance requirements for Zoning Board of Appeals and Planning Board members, the Town Board hereby authorizes the imposition of the following requirements as provided for in this article.

SECTION 3. Definitions. “Public meeting” shall refer to all open meetings as defined by the New York Open Meetings Law.

SECTION 4. Zoning Board of Appeals and Planning Board members’ minimum attendance requirements.

A. All members of the Zoning Board of Appeals and Planning Board shall be required to attend public meetings, as defined herein, and shall not be absent greater than two (2) times within each year from the date of their initial appointment to such Board. In addition, Zoning Board of Appeals and Planning Board members may not miss more than two (2) consecutive meetings.

B. Noncompliance with minimum requirements relating to attendance shall be deemed a proper cause for removal from such Board.

SECTION 5. Removal for cause. Nothing contained herein shall be deemed to limit or restrict the Town Board’s authority to remove a member from the Zoning Board of Appeals or Planning Board for cause (i.e., for other than the reasons enumerated herein).

SECTION 6. Excused absence. Nothing herein contained shall be deemed to limit the Town Board’s authority to waive a public hearing and excuse an absence upon good cause shown.

SECTION 7. When effective; applicability.

A. This article shall become effective upon filing with the Secretary of State of the State of New York.

B. This article shall apply to all members of the Town of Knox Zoning Board of Appeals and Planning

Board regardless of the date of theft appointment to such Boards.

C. Prospective members of the Zoning Board of Appeals and Planning Board shall be notified of the requirements of this article prior to their appointment to such Board.

D. General severability. If any clause, sentence, paragraph, section or item of this article shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not impair nor invalidate the remainder hereof, but such adjudication shall be confined in its operation to the clause, sentence paragraph, section or item directly involved in the controversy in which such judgment shall have been rendered.
