Burghoffer pleads guilty to driving drunk on ATV
David Burghoffer, 54, of Bethlehem, pleaded guilty to one count of aggravated driving while intoxicated, a felony, before the Judge Stephen W. Herrick in Albany County Court last week.
On March 10, at about 6:26 p.m., Burghoffer was stopped by Bethlehem Police after he was seen operating an all-terrain vehicle without headlights in the area of Old Town Road in Bethlehem, according to a release from the Albany County district Attorney’s Office.
Burghoffer failed field sobriety tests and registered a .27 percent blood alcohol content — more than three times the legal limit — when tested about an hour after the stop, the release said; he has five prior DWI convictions, and had a suspended license at the time of this arrest.
Burghoffer faces up to one to three years in state prison, a $1,000 fine, the installation of an ignition interlock device, and a minimum of 18 months of license revocation, subject to the Department of Motor Vehicles, when he is sentenced on Aug. 8.
