The Jan. 30 order from Chief Judge Brenda K. Sannes finalized a Dec. 3 preliminary injunction that prevented the village from interfering in construction of the facility.

While the proposal faces other questions, the ruling allows the approval process to proceed. 

The project is being developed by Pyramid Management Group, owners of the project-adjacent Crossgates Mall. 

In court papers filed Jan. 9, Shannon and Michael Folkin allege the town failed to advise them about wetland regulations and potential violations when approving their pool permit application.

During their July 19 meeting, Altamont Superintendent of Public Works Jeff Moller reminded trustees that the village still has restrictions in place. 

The villages of Altamont and Voorheesville continue to propose and adopt budgets that keep the municipalities below the state-set levy limit.
