Pyramid named in worker-injury suit

Crossgates Commons at 161 Washington Avenue Extension, pictured here, is in the city of Albany. The plaza’s owner, Pyramid Management Group, and one of its tenants were recently named in a personal injury lawsuit. 

ALBANY — The parent company of Crossgates Mall and an indoor-entertainment center located in the Pyramid Management Group-owned Crossgates Commons, just over the Guilderland townline in the city of Albany, are facing a personal-injury lawsuit from a worker employed by a mattress retailer also located in the plaza. 

The Sept. 22 lawsuit was filed by Mattress Express employee Kimberly Blasiak against Pyramid, a half-dozen of its local LLCs, and Urban Air Adventure Park. Blasiak is a member of the Guilderland School Board.

The defendants did not immediately respond to a request for comment; the plaintiff referred all requests to her attorney. 

The brief filing states that, in January of last year, Blasiak began to notice smoke billowing up from the adventure park located “directly beneath” Mattress Xpress’s Washington Avenue-facing location. 

Blasiak claims that, in her attempt to determine the source of the smoke, she fell through an unguarded and inadequately secured hole, plummeting 25 feet to the floor below, sustaining severe and permanent injuries in the process.

The court complaint asserts three causes of action:

— That Pyramid, Urban Air Adventure Park, their agents, employees, and contractors created or allowed and unguarded hole in the floor to be covered with unsecured plywood, which the court filing states was negligent, careless, and reckless; 

— By creating, allowing, or failing to correct the dangerous condition and failing to provide adequate warning, Blasiak claims the defendants breached their duty to maintain a reasonably safe site; and 

— The uncovered floor opening violated New York State health, labor, and industrial laws. 

Blasiak’s damages request to the court “exceeds the jurisdictional limits,” meaning she is seeking an award beyond what a lower court like small claims, where her case would otherwise have been filed, could approve for her.
