Boozy Moo’s already-in-operation ice-cream parlor OK’d by planning board

Boozy Moo’s addition of a walk-up retail window and patio space put the business out of compliance with its original site-plan approval. After being notified of the non-compliance, the company recently applied and was given town permission to operate the retail shop. 

NEW SCOTLAND — The New Scotland Planning Board recently approved a change in use for Boozy Moo! Ice Cream in New Salem, allowing the previously-approved kitchen and production site at 705 New Salem Road to operate as a retail shop.

The planning board in May 2023 approved owner Leyla Kiosse to move production from her downtown Albany bar to the New Salem Road location, the site of the former New Salem firehouse next to the Punkintown Fair. 

Boozy Moo’s earlier addition of a walk-up retail window and patio space put the business out of compliance with its original site-plan approval. After being notified of the non-compliance, Kiosse was required to seek new plan approval from the board, which had determined the change in use fell under its regulatory purview. 

In July, the board granted Boozy Moo conditional site approval, giving the business temporary permission to continue operating, insulating it from further enforcement actions by the town.

Kiosse intends the walk-up window to be seasonal, from April through October, open Tuesday through Thursday, from 8 a.m. to 2 p.m., closed for two hours, then open again from 4 p.m. to 8 p.m., and Saturday from 9 a.m. to 9 p.m.
