NOTICE OF PUBLIC HEARING

 PLEASE TAKE NOTICE that a public hearing will be conducted at the New Salem Volunteer Fire Department., at 694 New Salem Road, Voorheesville, NY 12186 on June 6, 2019 at 7:00 p.m. in relation to the proposed construction of fire station building by the New Salem Volunteer Fire Department.  The fire company proposes to finance up to $250,000.00 of the purchase price with a loan/promissory note to Ballston Spa National Bank.

 The total construction cost is estimated to be $400,000.00. The loan obligation is in the maximum principal amount of $250,000.00. The new building is to replace the existing fire station building at 2069 New Scotland Road and is to be used for the provision of the fire protection service to the Town of New Scotland Fire Protection District “pursuant to a contract dated 010119-123119 between the New Salem Volunteer Fire Dept. and the Town of New Scotland. Fire-fighting equipment is to be garaged at the proposed new station at 2069 New Scotland Road.  The existing building will be demolished. 

 The public hearing and any subsequent approval of the borrowing and issuance of the obligation are prerequisites to exemption from income taxation of the interest payable under the terms of such obligation, pursuant to section 103 (and related sections of, and regulations under) of the Internal Revenue Code.

 Persons attending the public hearing will be given the opportunity to make statements in connection with the proposed financing; written comments may be submitted to the Hearing Officer at or prior to the public hearing.

Ethics Board Vacancy

The Town Board of the Town of New Scotland is accepting resumes for a vacancy on the Ethics Board.  Qualifications are as follows:

Members of the Ethics Board shall be residents of the Town of New Scotland. 

The total membership of the Ethics Board is restricted to a maximum number of members registered in the same political party.  The current vacancy needs to be filled by an individual who is either:  1) not enrolled in any party or 2) who is a member of any political party other than the Democrat party. 

No Ethics Board member shall concurrently hold office in a political party or be employed or act as a lobbyist or hold elective office in any local, state, or federal government.

The term of the Ethics Board member shall be three years and shall run from January 1 to December 31.

Members of the Ethics Board serve at the pleasure of the Town Board and receive no salary or compensation.

Notice is hereby given that the Zoning Board of Town of New Scotland, New York will hold a public hearing pursuant to Chapter 190, Article IX, Section 190-73 of the Zoning Law on the following proposition:

A Public Hearing for Variance Application # 530

1. Variance Application # 530: Application submitted by Tommell Livestock LLC as a two part application. The first part is to request an appeal of determination for a violation given by the Building Inspector that the use of the parcel as a commercial public garage is not a current allowed use for the parcel.  The second part of the application is a request to “renew” a use variance previously granted for this parcel to allow for the operation and use as a public garage. The parcel is located in the RA district at 173 North Rd. and is identified as tax parcel # 105.-3-6.10.

Zoning Board Notice is hereby given that the Zoning Board of Town of New Scotland, New York will hold a public hearing pursuant to Chapter 190, Article IX, Section 190-73 of the Zoning Law on the following proposition:

A Public Hearing for Variance Application # 533

Variance Application # 533: Application Submitted by Stewart’s Corporation requesting relief from Article II, Section 190-16 (B) of the Town of New Scotland’s Zoning Law to allow for a new building to be constructed within the front and rear setbacks on a parcel. The parcel is located within the “CH” district at 1360 Indian Fields Road. The parcel is owned by the Stewart’s Corporation, is identified as New Scotland Tax parcel id # 107.2-2-58. The “CH” district has a front and rear setback of 30 feet. This request is for 26 feet of front setback relief to allow for the fuel canopy to be located within 4’ of the front property line and for 19’ of rear setback relief to allow for the new store to be located 11 feet from the rear property line. This application also requests 13’ of relief for the sign to be located 2 feet from the front property line.

Said hearing will take place on May 28, 2019 at the New Scotland Town Hall 7:00 P.M.
