Extension of Proclamation of Local State of Emergency in

TOWN OF WESTERLO

Declaration of the Town Supervisor 

Declaring an Extension to the Local State of Emergency in the Town of Westerlo, Albany County, State of New York

WHEREAS, on March 16, 2020, I issued a Proclamation of a local state of emergency for the Town of Westerlo in response to the COVID-19 outbreak, which was and continues to be a pandemic public health emergency of international, state, and local concern threatening the health and welfare of the residents of the Town of Westerlo ;

WHEREAS, under the March 16, 2020 declaration of a local state of emergency, I issued the following emergency orders protect life and health and to bring the emergency situation under control:

(a) In cooperation with the Westerlo Library Director, I am directing the Westerlo Library be closed. I further direct the Westerlo Town Hall be closed to the public with exception of the March 17th regularly scheduled Town Board meeting. Additionally , all planning board meetings, zoning board meetings, and all committee meetings are cancelled.

(b) The Town Highway Department employees will no longer report for work unless in the event their essential services are required.

Additionally, the Town Transfer Station will ONLY be open on Saturday 8:00 am - 3:45 pm, Sunday 8:00 am - 11 :45 am.

WHEREAS, the findings and conditions that led to the issuance of such Proclamation have continued and worsened.

NOW, THEREFORE , I, William F. Bichteman Jr., Supervisor of the Town of Westerlo, by virtue of the authority vested in me under§ 24 of the New York State Executive Law, do hereby proclaim and declare a continued local state of emergency for the Town of Westerlo and order as follows:

(1) The state of local emergency due to COVID-19 as set forth above shall be extended and continue to be in effect, and shall terminate on May 15, 2020, unless rescinded on an earlier date by me; and

(2) All of the orders and directives set forth in my initial Proclamation, effective March 17, 2020, are hereby renewed and re-issued as if fully incorporated herein.

I FURTHER ORDER THE FOLLOWING:

(1) The Executive Order cancelling Town Board meetings, planning board meetings, zoning board meetings and committee meetings is hereby modified to allow virtual meetings in accordance with the Governors Executive order 202.1 modifying the Open Meetings Law. Town Board meetings, planning board meetings , zoning board meetings and comprehensive plan committee meetings conducted on the following :

(a) The meeting is absolutely and immediately necessary to the function of Town of Westerlo government.

(b) The meeting agenda sets forth the imperative.

(c) Board meetings be hosted from the Town Hall in a designated space, utilizing the Town’s platform (zoom) and equipment.

(d) Committee meetings may be held remotely and will employ the Town’s designated platform (zoom).

(e) Social distancing, face coverings and body temperature screenings apply to Town Hall meetings.

(f) Proposed meeting schedules require legal notices as specified in the Governors Executive Order and approval of the Town Supervisor.

Failure to obey this order is a criminal offense.

§ 24. In additional to all other criminal or civil sanction allowed under the law, any person who violates any provision of this Proclamation or any Emergency promulgated thereunder, including provisions carried over from my initial Proclamation, or who violates any currently effective provision of any executive order or proclamation issued by the Governor of the State of New York related to COVID-19, shall be guilty, upon conviction, of an offense punishable by a fine not less than $250 nor more than $1,000 or by imprisionment for a period not exceeding 15 days, or by both such fine and imprisonment.

NOTICE OF SPECIAL MEETING AND PUBLIC HEARING

ON A PROPOSED LOCAL LAW

OF THE TOWN OF BERNE

LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 20 of the Municipal Home Rule Law of the State of New York, a resolution of the Town Board of the Town of Berne, adopted April 15, 2020, and New York State Executive Order 202, the said Town Board will hold a special meeting and a public hearing on the 29 TH day of April, 2020 at 6:00 PM at the Berne Community & Senior Center, 1360 Helderberg Trail, Berne, New York to hear all interested parties and citizens regarding the adoption of proposed Local Law No. 4 of 2020, titled “Planning Board Membership”. The hearing may be adjourned from time to time as necessary.

The noticed special meeting and public hearing shall be held in accordance with New York State Executive Order 202 which restricts physical attendance by the general public at the meeting location but allows live public participation and comment by video or telephonic conference. Project Description:

The applicant proposes a permit modification to increase the Life of Mine area from 5 acres to 6.35 acres, and decrease the final mine floor elevation from 336 feet to 316 feet. The mine expansion is proposed along the eastern boundary to match contours and final elevations with the adjacent mine at a joint property line.

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

State Historic Preservation Act (SHPA) Determination

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

DEC Commisioner Policy 29, Environmental Justice Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

NOTICE TO BIDDER FOR PAVING PROJECT

PLEASE TAKE NOTICE that pursuant to resolution of the Town Board, Town of New Scotland, Albany County, New York sealed bids for Paving Project titled “Paving of Heldervale Subdivision” will be received at the office of the Town Clerk at Town Hall, Town of New Scotland, County of Albany, 2029 New Scotland Road Slingerlands, N.Y. 12159, until 10:00 A.M. on the 11th day of May, 2020 at which time they will be opened and read aloud. Bids will be submitted in duplicate in sealed envelopes which shall bear on the face thereof the name and address of the company and title, “Paving of Heldervale Subdivision”.  Detailed specifications and bid forms are available to any interested bidder at the office of the Highway Superintendent located at 2869 New Scotland Rd., Voorheesville, NY.

The contract for the paving project will be awarded by the Town Board to the lowest responsible bidder. In case where two or more responsible bidders submit identical bids as to price, the Town Board may reject any or all bids at its discretion.

The Town Board reserves the right to wave any informality in or to reject any or all bids.

All bids must be accompanied by Non-Collusion Bidding Certificate required by Section 103-d of the General Law.
