NOTICE OF PUBLIC HEARING, BUDGET AND PROPOSITION VOTE, AND ELECTION WITH VOTER REGISTRATION OF THE BERNE-KNOX-WESTERLO CENTRAL SCHOOL DISTRICT, TOWN OF BERNE, COUNTY OF ALBANY, NEW YORK
NOTICE IS HEREBY GIVEN by the Board of Education of the Berne-Knox-Westerlo Central School District, Albany County, New York, that a public hearing of the qualified voters of said school district will be held at the Elementary School Building, in said District, in the village of Berne, New York, on Tuesday, May 3, 2022, at 7:00 P.M., Daylight Savings Time for the presentation of the budget document for the 2022-23 fiscal year.
AND FURTHER NOTICE IS HEREBY GIVEN pursuant to Section 1716 of the Education Law, that a copy of the statement of the amount of money which will be required for the ensuing year for school purposes may be obtained by any qualified voter in the District during the fourteen (14) days immediately preceding the Budget Vote at the following location between the hours of 9:00 A.M. and 3:00 P.M.: District Office, Berne, New York
AND FURTHER NOTICE IS HEREBY GIVEN that the voting upon the appropriation of the necessary funds to meet the estimated expenditures and/or on propositions involving the expenditure of money to authorize the levy of taxes shall take place at the Elementary School Building on Tuesday, May 17, 2022, between the hours of 6:00 A.M. and 7:00 P.M.
AND FURTHER NOTICE IS HEREBY GIVEN pursuant to Section 2004 of the Education Law, that petitions nominating candidates for the Office of Member of the Board of Education must be filed with the Clerk of the District between the hours of 7:30 A.M. and 5:00 P.M. no later than, April 18, 2022, the 30th day preceding the Annual School District Meeting or election at which the candidates so nominated shall be elected, and that such election and voting upon the appropriation of funds shall constitute the Annual School District Meeting. The following vacancies are to be filled on the Board of Education: Two Three-Year Terms Commencing 7/1/22 and Ending 6/30/25 Each petition must be directed to the Clerk of the Board of Education, must be signed by at least twenty-five (25) qualified voters of the District, or two (2) percent of the voters who voted in the 2021 election whichever is greater, shall state the name and residence of the candidate. Petition forms are available at the Office of the Clerk of the District, 1738 Helderberg Trail, Berne, NY 12023. Voting for the election of Candidates for the Office of Member of the Board of Education will take place at the Elementary School Building on Tuesday, May 17, 2022 between the hours of 6:00 A.M. and 7:00 P.M.
AND FURTHER NOTICE IS HEREBY GIVEN that the following propositions will be submitted to the voters:
Proposition #1
RESOLVED: that the Board of Education of the Berne Knox Westerlo Central School District is authorized to acquire by purchase from James F. Conklin and Kimberly D. Conklin that certain real property and improvements known as 1772 Helderberg Trail, located in the Town of Berne, New York, bearing Tax Map No. 78.-3-27 and having a lot size of approximately 1.1 acres, at a cost not to exceed
$410,000.00, and said sum is hereby appropriated for out of the District’s unappropriated fund balance.
Proposition #2
ACQUISITION OF SCHOOL BUSES AND VEHICLES
RESOLVED: Shall the Board of Education of the Berne-Knox Westerlo Central School District be authorized to (A) purchase school buses at a cost not to exceed $554,734, (B) expend such sum for such purpose, including the expenditure of $150,000 from the Transportation Reserve Fund, (C) levy the necessary tax therefore, to be levied and collected in annual installments in such years and in such amounts as may be determined by the Board of Education in accordance with Section 416 of the Education Law, taking into account state aid received and the amount expended from the Transportation Reserve Fund, and (D) in anticipation of the collection of such tax, issue bonds and notes of the District at one time or from time to time in the principal amount not to exceed $404,734 and levy a tax to pay the interest on said obligations when due?
AND FURTHER NOTICE IS HEREBY GIVEN, that pursuant to Chapter 258 of the Laws of Section 2008, Section 495 was added to the Real Property Tax Law and requires the School District to attach to its proposed budget an exemption report. Said exemption report, which will also become part of the final budget, will show how much the total assessed value on
the final assessment roll used in the budgetary process is exempt from taxation, list every type of exemption granted, identify by statutory authority, and show: (a) the cumulative impact of each type of exemption expressed either as a dollar amount of assessed value or as a percentage of the
total assessed value on the roll; (b) the cumulative amount expected to be received from recipients of each type of exemption as payments in lieu of taxes or other payments for municipal services; and (c) the cumulative impact of all exemptions granted. The exemption report shall be posted on any bulletin board maintained by the District for public notices and on any website maintained by the District.
AND FURTHER NOTICE IS HEREBY GIVEN that personal registration of voters is required either pursuant to Section 2014 of New York State Education Law or pursuant to Article 5 of the New York State Election Law. If a voter has heretofore registered pursuant to Section 2014 of the New York State Education Law and has voted at any annual or special district meeting within the past four (4) calendar years, such voter is eligible to vote at this election; if a voter is registered and eligible to vote pursuant to Article 5 of the New York State Election Law, such voter is also eligible to vote at this election. All other persons who wish to vote must register. Applications can be obtained at

AND FURTHER NOTICE IS HEREBY GIVEN that applications for absentee ballots may be applied for at the office of the Clerk of the District. If the ballot is to be mailed to the voter, the completed application must be received by the District no later than 3:00 P.M. on May 10, 2022. If the ballot is to be delivered personally by the voter, the completed application must
be received by the Clerk of the District no later than 5:00 P.M. on May 16, 2022. A list of all persons to whom absentee ballots have been issued will be available for inspection by any qualified voter of the District in the Office of the Clerk of the District between the hours of 7:30 A.M. and 3:30 P.M. during the five days prior to the day of the Annual Meeting.
AND FURTHER NOTICE IS HEREBY GIVEN, that military voters who are qualified voters of the Berne-Knox-Westerlo Central School District may request an application for a military ballot from the District Clerk by mail to the Office of the Clerk of the District, 1738 Helderberg Trail, Berne, NY 12023, or by email to the District Clerk at
, or fax sent to 518-872-0938. In such request, the military voter may indicate their preference for receiving the application by mail, fax or email. A military voter must return the original military ballot application by mail to the Office of the Clerk of the District at 1738 Helderberg Trail, Berne, NY 12023. In order for a military voter to be issued a military ballot, a valid military ballot application must be received in the office of the District Clerk no later than 5:00 p.m. on April 21, 2022. Military ballot applications received in accordance with the foregoing will be processed in the same manner as a non-military ballot application under §2018-a of the Education Law. The application for military ballots may include the military voter’s preference for receipt of the military ballot by mail, fax or email.

NOTICE IS HEREBY GIVEN that at a regular meeting of the Board of Trustees of the Village of Altamont held on the 5th day of April 2022, a Resolution was duly adopted, an abstract of which follows, which Resolution is subject to a permissive referendum pursuant to New York Village Law Article 9.
The Village Board of Trustees authorized for the Village to expend up to $344,415 from Fire Equipment Reserve Fund to purchase Toyne Top Mount Custom Pumper on a Spartan Metro Star chassis for Altamont Fire Department.

NOTICE IS HEREBY GIVEN, that the Town of Westerlo Town Board has scheduled three Public Hearings on Tuesday, April 19th at 6 PM at the Richard Rapp Municipal Building, 933 County Route 401, Westerlo, NY 12193. The first Public Hearing is regarding a proposed law to amend Local Law #2 of 2021 entitled “Battery Energy Storage Systems Local Law”. The second Public Hearing is regarding a proposed law to amend Local Law #1 of 2020 entitled “A Local Law Amending The Town Zoning Law Regarding Code Enforcement”. The third Public Hearing is regarding a proposed law to Authorize Best Value Procurement. The Regular Town Board meeting will immediately follow the Public Hearings where the Town Board intends to take action on the proposed laws.
The proposed local laws are available for public inspection at the Town Clerk’s office at 933 County Route 401, Westerlo, NY, during office hours, Monday through Friday and on the Town website, www.townofwesterlony.com.
