GUILDERLAND — After a bench trial before Judge John Bailey in Guilderland Town Court Tuesday afternoon, Sara J. Herrero was found guilty of two counts of driving while intoxicated, both misdemeanors.

Herrero, 39, of Clifton Park, struck a delineator pole while merging onto the eastbound lanes of Exit 29 on Interstate 90 in Guilderland, according to a release from the Albany county district Attorney’s Office. The accident took place on July 8, 2012 at about 3 p.m.

Debris from the crash hit the vehicle of a nearby driver.  The victim was able to call the police and members of the New York State Police responded.  Herrero was arrested after she repeatedly failed field sobriety testing and was found to have a .11 blood-alcohol level after a Datamaster Breathalyzer test, the release said.

Herrero faces up to one year in local jail when sentenced on Nov. 10.

Criminal Law Associate Collin D’Arcy and Assistant District Attorney Dennis DiBari of the Major Crimes Unit handled the prosecution of this case.
