Pursuant to an Order Confirming Referee Report and Judgment of Foreclosure and Sale duly entered on January 20, 2023, I, the undersigned Referee will sell at public auction at the Albany County Courthouse, basement level rotunda, 16 Eagle Street, Albany, NY on April 4, 2023 at 10:00 a.m., premises known as 63 Pinewood Avenue, Albany, NY 12208. All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the City of Albany, County of Albany and State of New York, Section 75.34, Block 2 and Lot 79. Approximate amount of judgment is $143,725.70 plus interest and costs. Premises will be sold subject to provisions of filed Judgment Index #905554-19. FORT HUNTER FIRE DISTRICT
The bond resolution, a summary of which is published herewith, was adopted on the 9th day of November, 2022 and was approved by referendum on December 13th, 2022, and the validity of the obligations authorized by such resolution may be hereafter contested only if such obligations were authorized for an object or purpose for which the Fort Hunter Fire District, Town of Guilderland, New York is not authorized to expend money or if the provisions of law which should have been complied with as of the date of publication of this notice were not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of publication of this notice, or such obligations were authorized in violation of the provisions of the constitution.

The following is a summary of said bond resolution:
The title of the bond resolution is: “BOND RESOLUTION OF THE BOARD OF FIRE COMMISSIONERS OF THE FORT HUNTER FIRE DISTRICT, TOWN OF GUILDERLAND, ALBANY COUNTY, NEW YORK, ADOPTED NOVEMBER 9, 2022, AUTHORIZING THE RECONSTRUCTION OF THE DISTRICT’S FIREHOUSE, A CLASS “B” BUILDING, INCLUDING GRADING AND IMPROVEMENT OF THE SITE, ORIGINAL FURNISHINGS, EQUIPMENT, MACHINERY, AND APPARATUS, REQUIRED FOR THE PURPOSE FOR WHICH SUCH RECONSTRUCTED BUILDING IS TO BE USED, STATING THE ESTIMATED MAXIMUM COST OF SAID RECONSTRUCTION, TOGETHER WITH CERTAIN COSTS PRELIMINARY AND INCIDENTAL THERETO IS $1,500,000, APPROPRIATING SAID SUM THEREFOR AND AUTHORIZING THE ISSUANCE OF UP TO $1,500,000 AGGREGATE PRINCIPAL AMOUNT OF SERIAL BONDS OF THE FIRE DISTRICT TO FINANCE SAID APPROPRIATION.”
The bond resolution, among other things, authorized the Fort Hunter Fire District, Town of Guilderland, New York (the “Fire District”) to reconstruct the District’s firehouse located at 3525 Carman Road in the Town of Guilderland (the “Firehouse”), including grading and improvement of the site, original furnishings, equipment, machinery and apparatus required for the purpose for which such reconstructed building is to be used, specifically including sidewalk replacement, milling and repaving of existing parking lot, roof replacement, electrical upgrades, installation of Uninstrut behind electric panels, ceiling improvements, kitchen and coffee bar reconstruction and upgrades, partial replacement of sanitary main, carpet and tile replacement, fire protection related reconstruction and improvements, replacement of VCT, and wall painting and epoxy floors related to reconstruction (collectively, the “Project”).
The bond resolution stated that the estimated maximum cost of the Project is $1,500,000 and said amount was appropriated therefor in the bond resolution. To finance a portion of said cost, the Fire District was authorized in the bond resolution to issue serial bonds of the Fire District, in one or more series, in the principal amount of up to $1,500,000 pursuant to and in accordance with the provisions of the Local Finance Law, constituting Chapter 33-A of the Consolidated Laws of the State of New York (the “Law”).
The period of probable usefulness of the Project for which the bonds authorized by this resolution are to be issued is fifteen (15) years, as provided in subdivision 12(a)(2) of Section 11.00(a) of the Law.

LEGAL NOTICE
Notice of Permissive Referendum
NOTICE IS HEREBY GIVEN that the Board of Fire Commissioners of the Berne Fire District at a scheduled meeting held on the 14th day of February 2023, duly adopted the following Resolution, subject to a permissive referendum.
RESOLUTION WHEREAS, the Berne Fire District, under the obligation and authority to purchase apparatus for the extinguishment and prevention of fires and for the purpose of emergency rescue (Town Law §176.13), determined there to be such a need to purchase a certain fire apparatus, more specifically a 2004 E1 Pumper-Rescue truck, now therefore, it
is;
RESOLVED by the Board of Fire Commissioners of the Berne Fire District that the District shall purchase a 2004 E1 Pumper-Rescue truck, and it is further;
RESOLVED that the purchase shall be made with monies withdrawn from the Equipment Reserve Fund not to exceed the sum of $45,000.00 and it is further;
RESOLVED that this Resolution is adopted subject to a permissive referendum.
PLEASE TAKE FURTHER NOTICE that the adoption of this Resolution is subject to permissive referendum pursuant to Section 6-g (3) of the General Municipal Law and shall take effect thirty (30) days after its adoption, unless there shall be filed in the interim with the Fire District Secretary a petition signed and acknowledged or approved in the same manner as a Deed to be recorded by resident tax payers of the District owning taxable real property aggregating at least 1⁄4 of the assessed valuation of all taxable real property of the Fire District as such valuations appear on the latest completed assessment of the Town of Berne, protesting against such Resolution and requesting that it be submitted to the qualified electors of the Fire District for their approval.
