TAX COLLECTOR’S NOTICE OF 

RECEIPT OF TAX ROLL 

AND WARRANT

TAKE NOTICE that I, the undersigned, Town Clerk and Tax Collector of the Town of Westerlo, County of Albany, State of New York have duly received the tax roll and warrant for the collection of taxes within the Town of Westerlo for the year 2018 and that I will receive taxes as follows:

Monday, Wednesday, and Friday between the hours of 8 AM and 4 PM, Tuesdays 8 AM to 3 PM and Thursday from 6 PM until 9 PM at the Westerlo Town Hall, 933 County Route 401, Westerlo, NY 12193

TAKE FURTHER NOTICE that taxes may be paid before February 1, 2018 without charge of interest.  On taxes remaining unpaid after January 31, there will be added one percent (1%) interest for the month of February and two percent (2%) interest added for the month of March.  The last possible date to pay at the Tax Collector’s office is Monday, April 2, 2018.

TAKE FURTHER NOTICE, that pursuant to the provisions of law the tax roll of the Town of Westerlo will be returned to the Albany County Treasurer after the 3rd day of April, 2018.

LEGAL NOTICE

PUBLIC NOTICE

The Town of Westerlo Town Board will hold two (2) Public Hearings on Tuesday, January 16, 2018 starting at 7 PM at Westerlo Town Hall 933 County Route 401, Westerlo, NY.  The first hearing shall be to discuss proposed Local Law No 1-2018 - Cold War Veterans Exemption to extend the property tax exemption for eligible Cold War Veterans beyond 10 yr. limitation set forth by NYS Real Property Tax Law.  The second public hearing shall be to discuss the proposed extension of Westerlo Water District No. 1 to include 560 State Route 143, Westerlo.  A full copy of the Order of the Town Board is set forth below.  A Special Town Board meeting for purpose of discussion of adoption of the proposed law and a Resolution to extend the water district will follow the Public Hearings.  The Special Town Board Meeting will then be followed by a Town Board Workshop meeting.

ORDER OF THE TOWN BOARD OF THE TOWN OF WESTERLO

TO HOLD A PUBLIC HEARING ON EXPANSION OF THE WESTERLO WATER DISTRICT #1 TO INCLUDE 560 SR 143, WESTERLO

WHEREAS, the Town of Westerlo formed the Westerlo Water District #1 (hereinafter referred to as the “Water District”) in 2002; and

WHEREAS, the boundaries of the Water District, and the properties included therein, are illustrated on the map labeled, WESTERLO WATER DISTRICT NO. 1, DISTRIBUTION MAIN PLAN SHEET INDEX, DATE:  NOVEMBER, 2005; and 

WHEREAS, 560 SR 143, Westerlo (sbl 139.9-2-22) (hereinafter referred to as “560 SR 143”) was not included in the Water District at the time of its initial formation; and

WHEREAS, 560 SR 143 is also shown on the WESTERLO WATER DISTRICT NO. 1, DISTRIBUTION MAIN PLAN SHEET INDEX, DATE:  NOVEMBER, 2005 map; and

WHEREAS, 560 SR 143 is legally described as:  THAT CERTAIN LOT, PIECE OR PARCEL OF LAND, with the buildings and improvements thereon erected, situate, lying and being in the Town of Westerlo, County of Albany and State of New York, bounded and described as follows:

BEGINNING at a point on the northerly boundary of State Route #143, thence running easterly along the boundary of State Route #143, distant seventy-three (73) feet to an iron pipe; thence northerly along the western boundary of the New York Telephone property distant eighty (80) feet to an iron pipe;  thence easterly along the boundary of the New York Telephone property, distant thirty-six (36)  feet to an iron pipe on the property line of Clifford Hannay; thence two hundred seventy-one (271) feet distant, northerly along last mentioned boundary to an iron pipe; thence two hundred seventy-one (271) feet distant westerly along southern boundary line of Clifford Lockwood to an iron pipe; thence one hundred twelve (112) feet distant southerly along the eastern boundary of Fred Lord property to an iron pipe thence one hundred thirty-one(131) feet distant easterly to an iron pipe; thence three hundred twenty-one (321) feet distant southerly along the eastern boundary line of the Fred Lord and the Reformed Church properties to the point of beginning, being one and one-third acres more or less.

WHEREAS, the owner of 560 SR 143, Westerlo, to wit:  Windy Hill Properties LLC, has applied to the Town of Westerlo for an extension of the Water District to include said property in the Water District; and

WHEREAS, the applicant has agreed to bear all administrative, legal and engineering costs associated with the cost of the extension; and

WHEREAS, the applicant shall also bear the contractor costs of connection to the Water District, as well as the standard connection fee of $385; and

WHEREAS, there is no financing required for the requested extension; and

WHEREAS, the map depicting the existing Water District boundaries as well as the subject parcel is on file with the Town Clerk of the Town of Westerlo for public inspection; and

WHEREAS, the extension of the Water District to include the subject property will reduce the overall financial burden to the Water District Residents since an additional property will participate in the repayment of the bond debt and therefore reduce each property’s pro rata share of the repayment; and

WHEREAS, the addition of the subject property will have no detriment to the existing Water District; now it is 

SO ORDERED that the Town of Westerlo will hold a public hearing on January 16th, 2018 to discuss expanding the Water District to include 560 SR 143; and it is further

ORDERED, that this Order shall be published in the Altamont Enterprise at least once, no less than ten nor more than twenty days before the date of the public hearing, as required by law; and it is further ORDERED, that this Order shall be posted on the sign-board of the Town not less than ten nor more than twenty days before the date of the public hearing; and it is further ORDERED, that a copy of this Order shall be filed with the NYS Comptroller on or about the date of the publication of a copy of the Order.
