Police say Westerlo man threw woman to the ground

WESTERLO — A Westerlo man was arrested following a night of drinking for choking and throwing a woman to the ground following an argument, police say.

Franklin Hempstead, 22, of Westerlo, was arrested in Westerlo around 4 a.m. on Saturday, Dec. 8, by Albany County Sheriff’s deputies, according to the arrest report issued by the sheriff’s office. He looked drunk, the report says.

The woman, who lived with Hempstead, said that Hempstead was going through her phone after a night of drinking and became upset, the report says. When she tried to leave her home, Hempstead placed his hands around her neck so she couldn’t breathe before throwing her to the ground, the report says.

She said she had scrapes from being thrown to the ground and pain in her head and elbows from being pushed against a truck, the report says.

Hempstead was charged with third-degree assault with intent to cause injury and criminal obstruction of breathing, both misdemeanors. He was arraigned in Westerlo Town Court and released on his own recognizance to probation officers. He was also issued a temporary stay-away order to protect the woman.
