Project Description:
The Department has prepared a draft permit and has made a tentative determination, subject to public comment or other information, to approve a modification to the existing SPDES permit for the discharge of 3,200 gallons per day of treated wastewater to an unmapped tributary to Vly Creek, a Class C waterbody, from the Town of New Scotland Highway Garage, located at 2869 New Scotland Road, Voorheesville. The proposed permit modification removes the Schedule of Compliance and adjusts the water quality based effluent limits (WQBEL) to account for the stream’s dilution (Total Dissolved Solids, Iron, Lead, and Zinc). In the previous permit conditions, the permittee was required to monitor the flow rate of the receiving waters for 12 consecutive months. The stream had previously been identified as an intermittent stream but has now been identified as a perennial stream; therefore, dilution from the stream is being accounted for with this modification. The draft permit files are contained within regional folders and named by the SPDES number contained in this notice. Requests for a legislative (public statement) hearing must be sent in writing to the DEC contact person below by the comment deadline. The Department assesses such requests pursuant to 6 NYCRR Section 621.8. Refer to this application by the application number listed above and SPDES Number NY0282511.

PUBLIC HEARING
PLEASE TAKE NOTICE, the Town of Westerlo Zoning Board will hold a Public Hearing on Monday, November 27, 2023 at 7 Pm for a variance for Joseph and Dawn Kralovich located at 82 Elm Lane Ext. V-23-6, SBL# 184.-1-16.1. The applicant would like to sub-divide his 40-acre lot to create a 3-acre lot for his father to build a house. He is seeking relief of 25 feet from Zoning, Article 6 definition (flag lot). Flag lots require the flag corridor to be no less than fifty feet. The existing lot has 50 feet of road frontage on Elm Lane Ext. The applicant proposes to use 25 feet for each lot for the flag corridor. The Public Hearing will be held at the Richard Rapp Municipal Building (Town Hall) located at 933 CR 401 in Westerlo.
