TOWN OF GUILDERLAND
NOTICE OF ADOPTION OF RESOLUTION NO. 4 of 2024
SUBJECT TO PERMISSIVE REFERENDUM
NOTICE IS HEREBY GIVEN that at a regular meeting held on the 21st day of May, 2024, the Town Board of the Town of Guilderland, Albany County, New York, duly adopted Resolution No. 4-2024 entitled:
AUTHORIZING A PROPERTY EXCHANGE BETWEEN THE TOWN AND NORTHEAST IP HOLDINGS, INC.
WHEREAS, the Town of Guilderland (hereinafter the “Town”) has determined that a new fire training facility to be constructed on certain real property owned by Northeastern IP Holdings, Inc (“NEIP”) for the public benefit; and
WHEREAS, the Town owns excess property consisting of approximately 6.10 acres, identified as tax map parcel no. 50.00-1-16, which is currently not used by the Town to serve a public purpose; and
WHEREAS, NEIP owns certain real property consisting of approximately 4.75 acres, which will be subdivided from tax parcel no. 50.00-1-14.11/1, that is suitable for the construction of a new fire training facility. This property is currently being leased by the Town for the current fire training facility; and
WHEREAS, the Town and NEIP wish to exchange ownership of said parcels as described above; and
WHEREAS, the Town and NEIP have agreed in principle to an exchange of property, as described in the Agreement Regarding Exchange of Land attached as Resolution Exhibit 1 (the “Agreement”); and
WHEREAS, NYS Town Law § 64 authorizes the sale or acquisition of real property with a private party if, among other things, the Town receives at least equivalent value for the property it transfers; and
WHEREAS, this resolution is an inducement for AmTrust Title Insurance Company and SMPR Title Agency, Inc. to issue certificates for title insurance (SMPR Order No.: A-0143017 and SMPR Order No.: A-0143018) for the exchange of the properties; and
WHEREAS, the Town has determined that the property being received in the exchange meets the requirements of NYS Town Law § 64 as the property owned by the Town does not have value to the Town as it is only accessible by the Town for certain restrictive purposes. The Town and the public will receive a substantial benefit from the exchange as the land being received is suitable for the construction of the new fire training facility and other improvements without restriction. The Town is receiving equivalent value in the exchange.
NOW, THEREFORE, BE IT RESOLVED THAT
1. The Town Board hereby confirms its designation as Lead Agency under the State Environmental Quality Review Act (“SEQRA”).
2. The Town Board has determined that this is an Unlisted action that will not have a significant effect on the environment and, therefore, no other determination or procedure under SEQRA is required.
3. The Town Board approves of the land exchange Agreement attached as Exhibit 1.
4. The Supervisor and/or Town Attorney are authorized to exchange with NEIP the above-described real properties.
5. The Supervisor and/or Town Attorney are authorized to sign all documents necessary to transfer and receive the above-described real properties.
Pursuant to NYS Town Law § 90 and NYS General Municipal Law § 6-c (4), this resolution is subject to a permissive referendum.
This Resolution was unanimously adopted by the Town Board of the Town of Guilderland on May 21, 2024. Moved by: Councilwoman Beedle, Seconded by: Councilman Crawford
Said resolution shall take effect forty-five days after adoption, unless there shall be filed with the Town Clerk a petition signed and acknowledged by the electors of the Town qualified to vote upon a proposition to raise and expend money, in number equal to at least ten per centum of the total vote cast for governor in the Town at the last general election held for the election of State officers, protesting against the resolution and requesting that the matter be submitted to the qualified electors of the Town at a referendum in the manner provided by the Town Law.

LEGAL NOTICE
For the approval of a Cable Television Agreement between Spectrum Northeast, LLC and the Town of Knox.
PLEASE TAKE NOTICE that the Town of Knox will hold a Public Hearing on Tuesday, June 11 at 7:30 p.m. at the Town Hall, 2192 Berne Altamont Road in Knox, New York regarding renewal of the cable television franchise agreement by and between the town of Knox and Spectrum Northeast, LLC, an indirect subsidiary of Charter Communications.
A copy of the agreement is available for public inspection during normal business hours at the Clerk’s office, 2192 Berne Altamont Road, Knox, New York. At such public hearing, all persons will be given an opportunity to be heard. Written and oral statements will be taken at that time. Time limitations may be imposed for each oral statement, if necessary.

Notice of Visual Assessment
Town of Berne – TJA Clean Energy Solar Array Project
The Town of Berne is currently reviewing a Special Use Permit Application for a Tier 3 solar array proposed to be constructed near the intersection of Canaday Hill Road and Switzkill Road on Tax Parcel #78.-3.16.12. As part of the Town’s review of this project, a field verified visual assessment of the proposed solar array is being conducted as part of the review of the Special Use Permit. In addition to renderings generated by the applicant, the Town has requested that the applicant perform field verification of the proposed array such that the visual impacts of the proposed array can be adequately assessed by the Town and residents. Temporary monumentation such as ballons, balls, or flags are proposed to be placed along the highest and most visible part of the array to assess its impact. This monumentation will be in place from June 10, 2024, through June 16, 2024. If you would like to provide comments on the visual impact of the proposed array, please forward these comments to:

NOTICE OF PUBLIC HEARING ON PROPOSED LOCAL LAW # 3 of 2024
A Local Law to abolish the Planning Board and transfer its functions to the Zoning Board of Appeals, which is to be known as the “Planning Board/Zoning Board of Appeals”.
NOTICE IS HEREBY GIVEN, that the Town Board of the Town of Westerlo will hold a Public Hearing on June 18, 2024, beginning at 6 pm at Westerlo Town Hall, 933 CR 401, Westerlo NY concerning Proposed Local Law # 3 of 2024 as described above.
A copy of the Proposed Local Law is on file in the Town Clerk’s Office and is available on the Town website.
