Project Description:
In 2019, the New York State Department of Environmental Conservation (DEC) issued a renewal and Department Initiated Modification to the State Discharge Elimination System (SPDES) Permit NY0268976, pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State’s Environmental Benefit Permit Strategy (EBPS). This modification was also reviewed under the Mohawk River Source Water Protection Program.
The facility, located on State Route 443 west of the Berne-Knox-Westerlo school district, has a designed flow of 30,000 gallons per day, and discharged treated sewage via outfall 001 to Fox Creek, a Class C water.
Treatment consists of septic tanks, recirculating tanks, and sand filters. Seasonal disinfection requirements and a schedule of compliance for the new disinfection requirements were also added to the permit.
This permit is being renoticed because the schedule of compliance is being modified to extend completion due dates for design and commencement of construction in order to provide adequate time to apply for financial opportunities. The construction completion, commence operation, and complying with new effluent limitations due date has not been modified.
Requests for a legislative (public statement) hearing must be sent in writing to the DEC contact person below by the comment deadline. The Department assesses such requests pursuant to 6 NYCRR Section 621.8.

Project Description:
The applicant proposes a proposed discharge of 5,075 gallons per day of treated sanitary via Outfall 005 to groundwater from a raised subsurface system treatment plant at the applicant’s facility address located at NYS John Boyd Thacher State Park, 1 Hailes Cave Rd. The facility is currently permitted under SPDES Number NY 002 9092 to discharge treated sanitary sewage via surface discharge to Unnamed Tributary to the Black Creek (Class C stream) via Outfall 001 and discharge treated sanitary sewage to ground water via Outfalls 002-004, 006-008. The applicant is proposing to abandon the existing sewer connection from the Visitors Center and Police Station and install two 2” force main lines. The lines run for approximately 1,000 LF but approximately 610 LF will be installed within an existing 6” sewer line. The two lines run in parallel for approximately 670 LF to an existing manhole. From here, one line runs to the north field for another 314 LF (984 LF total) and the other line runs to the south field for another 146 LF (816 LF total). There is also a new line from the Police Building to the southernmost septic field, a distance of 235 LF. The work also includes installation of two new absorption fields, approximately 86’x94’ each, installation of a 7,500 gallon septic tank, installation of two new distribution boxes, relocation of existing tres, and abondonment of the existing sewage pump building. The end goal is to eventually eliminate the sewage treatment plant at the park. After this proposed project is complete, the only remaining discharge to the existing plant is from the Nature Center at Thompsons Lake.
