60-year-old collared for felony gun possession

GUILDERLAND — A Florida man was arrested on Friday night after he was found asleep at the wheel of his truck, which was parked in a driving lane on Western Avenue.

Richard W. Browne, 60, of Sarasota, Florida, was observed in his 1998 GMC pickup truck at 9:27 p.m. on Aug. 15, according to a press release from the Guilderland Police Department.

The release described Browne as “confused and unresponsive to officers,” and Captain Curtis Cox said Browne had been asleep, and then was unable to figure out how to open his truck door, because it was locked.

Officers broke the window on Browne’s truck in order to unlock the door, said Cox.

Browne was given standardized field sobriety tests to determine intoxication or impairment. He failed the tests and was charged with driving while ability impaired by drugs, a misdemeanor, the release said.

Cox said Browne registered negative for alcohol on a screening device and a drug recognition expert determined he was under the influence of drugs.

During the investigation, Browne was found to be in possession of a Taurus .32 H&R Magnum revolver, and a quantity of ammunition for it. Cox said Browne did not have a permit for the gun. Cox said he did not know why Browne had the gun.

Browne was arrested for second-degree criminal possession of a weapon, a felony.

He was arraigned in the Guilderland Town Court on Aug. 16 and sent to Albany County’s jail without bail. He is due back in court today, Aug. 21.
