BERNE — A 25-year-old Berne man, police say, was arguing with his 21-year-old girlfriend on Monday evening when he fired a shotgun into a wall of their home to scare her.

Ryan A. Mcavoy, of 679 High Point Road, was charged by the Albany County Sheriff’s Department with two felonies and three misdemeanors.

“He did appear to be intoxicated,” said Undersheriff Craig Apple. “He had no job.”

Apple told The Enterprise, “This is basically a domestic dispute that got completely out of hand.”

Apple also said of Mcavoy, “He has been arrested before. He does have a criminal history…I can’t go into it.”

Both Albany County and Schoharie County deputies responded to the scene on Monday night. High Point Road is right near the county line, so the emergency 9-1-1 call, made at about 7 p.m. from 679 High Point Road, was first routed to the Schoharie County Sheriff’s Office, Apple said.

“They transferred it over in seconds,” he said. The female caller was screaming and then the call was disconnected, said Apple.

Schoharie had deputies closer than those dispatched from the Voorheesville substation in Albany County, Apple said.

When deputies arrived on the scene, they did not have to subdue Mcavoy, the undersheriff said.

“He had put the gun down and tried to conceal it. He was tearing out the Sheetrock that he shot,” said Apple.

Mcavoy was charged with two felonies — second-degree criminal possession of a weapon, and first-degree reckless endangerment. The charge for criminal possession of a weapon is first degree, Apple said, “if you’ve shot somebody,” and second degree “if you intend to use it.” Reckless endangerment is first degree, he said, if there’s a risk of death or injury, and second-degree if “if you’ve done something stupid, like with a car, that could have injured somebody.”

Mcavoy was also charged with three misdemeanors — second-degree menacing, fourth-degree criminal possession of a weapon, and fourth-degree criminal mischief.

He was arraigned in Berne Town Court before Judge Albert Raymond III and was remanded to Albany county’s jail with no bail.

Mcavoy is scheduled to appear on Thursday, Dec. 23, at 1 p.m. in Berne Town Court.
