Sex encounter leads to two arrests

GUILDERLAND — Prostitution arrests in Guilderland are few and far between, according to Captain Curtis Cox of the Guilderland Police Department. The transaction that took place between two men earlier this month was even more uncommon, said Cox.

A 36-year-old Vietnamese citizen, Ty Tran, was arrested on Nov. 8 for patronizing a prostitute, a misdemeanor, according to an arrest report. Tran, who lives in Albany in apartment 1 at 1 Admiral Street, was arrested only after he went to the Guilderland Police Department to report money that was stolen from him by 19-year-old Robert Fisher, from Guilderland. An investigation into the matter revealed that Tran had paid Fisher for a sexual encounter, before Fisher stole cash from Tran’s wallet, Cox said.

Tran is married, stands 5 feet, 5 inches tall, and weighs 150 pounds, according to the police report. Fisher, of 1700 Western Avenue, is single, stands 5 feet, 10 inches tall, and weighs 200 pounds, according to his arrest report. He was arrested by Guilderland Police in 2007 for fourth-degree criminal mischief, second-degree criminal contempt, and second-degree harassment, all misdemeanors.

The connection between Tran and Fisher is unclear, said Cox, but there is documentation of $50 given to Fisher by Tran over the course of two nights, although only the second night involved a sexual encounter, which took place on Strawberry Lane in Guilderland. Tran paid Fisher $50 in order for Fisher to allow Tran to perform oral sex on him, according to Cox.

At some point after the sexual transaction, Fisher stole $372 in cash from Tran’s wallet; after Tran reported the theft, Fisher was located, and arrested for petit larceny, a misdemeanor, according to the arrest report. Fisher told police he had hidden the cash in a trash bin behind his apartment building, where it was successfully located, said Cox.

Fisher appeared before Judge John Bailey in Guilderland Town Court on Nov. 19; he pleaded guilty to both petit larceny and attempted petit larceny, and was sentenced to three years of probation, according to court dockets. Tran will appear in court on Dec. 3, Cox said.

“We have occasional prostitution in town, but this was unusual,” said Cox.
