Charges of felony DWI for man who tried to flee, leaving kids behind
GUILDERLAND — On Oct. 14 at 7:45 p.m., State Police in Latham arrested Antwan Henry, 33, of Rensselaer for felony driving while intoxicated under Leandra’s Law, which makes it an automatic felony to drive drunk with children in the car.
Henry had four children under the age of 16 in the vehicle with him, according to a release from Troop G of the State Police.
Henry was stopped for speeding on the entrance to the Northway by Stuyvesant Plaza in Guilderland, and, after he failed field sobriety tests and the officer attempted to place him in handcuffs, he began to run down the roadway, leaving the children behind in the car, according to Trooper Mark Cepiel, public information officer for Troop G. The officer then caught up to him, and Henry “lay down in the road” and was taken into custody without further incident, Cepiel said.
Henry was charged with two felonies: DWI under Leandra’s Law and DWI with a previous conviction within the last 10 years, said Cepiel.
Leandra’s Law is named for Leandra Rosada, who was 11 when she died in a crash in New York City in a car driven by a friend of her mother’s who was allegedly drunk.
Henry was also charged with resisting arrest and second-degree reckless endangerment, both misdemeanors, and with speeding, an infraction, according to Cepiel.
After processing at the State Police barracks in Latham, Henry was arraigned in Guilderland Town Court, remanded to Albany County’s jail, and scheduled to reappear in court on Oct. 20 at 5:30 p.m.
