Kelly nabbed under Leandra's Law
GUILDERLAND — A man was arrested for driving drunk with his three children in the car on Friday, July 17.
Shaun P. Kelly was stopped by the Guilderland Police at 9:28 p.m. on Upper Hillcrest Avenue when he failed to stop at a stop sign, failed to signal a turn, and had an insufficient tail lamp on his car, according to a release from the department.
An investigation revealed that Kelly was intoxicated at the time of the arrest, with a blood alcohol content of .21 percent. His three children, ranging in age from 7 to 13 were in the car at the time of his arrest.
A check showed that Kelly’s license was suspended, the release said.
He was charged with a felony under Leandra’s Law — driving while intoxicated with a child in the vehicle, according to the release.
The state law, adopted in 2009, is named for Leandra Rosado, who was killed that year at age 11 in New York City when her friend’s mother, who was allegedly drunk, flipped the car, killing Rosado and injuring six other children.
Other charges included driving while intoxicated, driving with a blood alcohol content of .08 or greater, aggravated driving while intoxicated with a blood alcohol content of .18 or greater, aggravated unlicensed operation of a motor vehicle, three counts of endangering the welfare of a child, failure to stop at a stop sign, failure to indicate a turn, and insufficient tail lamps.
