Sex offender arrested for again contacting teenager

BERNE — A Berne man was arrested on Friday after contacting the same teenager he had been arrested for having sex with before, police say.

John E. McIntyre, 31, was pulled over by a sheriff’s investigator in the city of Albany on Friday and charged with second-degree criminal contempt, a misdemeanor, and failing to register a social-media account, which due to his status as a sex offender is in violation of the Sex Offender Registration Act and a felony, said Albany County Sheriff’s Senior Investigator Hector Fernandez.

McIntyre was also charged with failure to signal, a violation, and driving with a suspended license, a misdemeanor. He was arraigned in Berne Town Court and remanded to Albany County’s jail without bail, said Fernandez.

McIntyre was arrested last October for having sex with a 13-year-old girl after texting and messaging her over Facebook and SnapChat, police said. He was released from Albany County’s jail after applying to have bail issued and posting bail that same month, said Fernandez.

According to Fernandez, McIntyre created a new social-media account that he used to contact the same girl he had had sex with as before.

“We pretty much kind of kept tabs on him after he was released,” said Fernandez.

McIntyre, who lives at 1755 Helderberg Trail — a short distance from the Berne Public Library and from the Berne-Knox-Westerlo elementary and secondary schools — is a Level 2 registered sex offender; the state sets three levels with Level 2 representing a moderate risk of repeat offense.

McIntyre was sentenced to 10 years of probation in November 2006 after he was arrested by the Cohoes Police Department and convicted of sexual contact with an 8-year-old girl in 2004.

Shortly after his conviction in February 2007, McIntyre caused some concern in the Berne-Knox-Westerlo school community when he moved to an apartment on Witter Road in Knox. His probation was scheduled to end Jan. 11, 2017.

Another Berne resident by the name of John D. McIntyre, who is 18, was arrested last month in Berne for forcibly groping a 17-year-old female, police say; the two men are not related.

Once a predator, always a predator

Only 10 years of probation after sexual contact with an 8-year-old girl in 2004. Released on bail after sex with a 13 year old in 2018 and then makes contact with the same 13 year old. Society has to wake up and understand that these predators are, and always will be a risk. The only cure is their permanent removal from society. Too severe? Too bad. Anything less makes as much sense as catching and releasing rabid animals... nothing will change.
