A Berne jury found Brian Hoover, 43, of East Berne, guilty of two misdemeanors — driving while ability impaired by a drug, and driving while ability impaired by the combined influence of drugs.

Defense attorney Paul Van Ryn complained that a witness changed her story so he wasn't able to prepare for the trial held in Berne on June 15.

Jeffrey Richards, a public defender, and Brittany Grome, an assistant district attorney, clashed briefly in the small court in Berne Tuesday.

Marcia Pangburn's lawyer thinks she should have a jury in Berne, where she was arrested, but both town judges believe there may be an appearance of bias; a county judge will decide.

The hearing will review evidence, testimony and Pangburn's statements as she was arrested late at night visiting a Berne cemetery, to determine whether the evidence should be suppressed.

BERNE — A taxi driver arrested for forcing himself on a customer pleaded guilty in Berne Town Court on Sept. 9 to third-degree assault.

BERNE — A taxi driver arrested in May for keeping a woman in his taxi and touching her breasts without her consent is awaiting sentencing.

Appearing in Berne Town Court on Jan. 14, Mary Miesowicz and Harold Albright III faced much-reduced charges from their arrests for felony and misdemeanor offenses last March.
