NOTICE OF BOND RESOLUTION

NOTICE IS HEREBY GIVEN, that the resolution published herewith has been adopted by the Board of Fire Commissioners of the McKownville Fire District, Albany County on the 6th day of August, 2014. Such resolution was adopted subject to a mandatory referendum and such resolution was duly approved at a Special Election held on the 23th day of September, 2014, and the validity of the obligations authorized by such resolution and referendum may be hereafter contested only if 

1. A. Such obligations were authorized for an object or purpose for which the McKownville Fire District is not authorized to expend money;

-OR-

B. If the provisions of law which should have been complied with, as of the date of the publication of this notice, were not substantially complied with;

-AND-

C. An action, suit, or proceeding contesting such validity is commenced within twenty (20) days after the date of publication of this notice;

-OR-

2. Such obligations were authorized in violation of the provisions of the constitution of the State of New York.

SUMMARY OF THE RESOLUTION 

The following is a summary of the resolution adopted by the Board of Fire Commissioners of the McKownville Fire District on the 6th day of August, 2014 and approved at a Special Election by the qualified electors of the McKownville Fire District on September 23th, 2014. Such resolution was for the issuance of bond anticipation note(s) and/or serial bond(s) or a statutory installment bond(s) in an amount not to exceed $295,000.00 at the prevailing rate of interest for the purposes of acquiring apparatus.

The proceeds from the sale of the obligations authorized in said resolution shall be used for the specific purpose of financing:

I. The purchase of new fire apparatus. The acquisition of said apparatus is pursuant to the authority vested in the McKownville Fire District Board of Fire Commissioners by Section 176(14) of the Town Law of the State of New York. 

Il. The purchase price is not to exceed $495,000.00 

III. The plan of financing is to issue a serial bond or bonds, statutory installment bond or bonds and/or bond anticipation noted or notes in an amount not to exceed $295,000.00 and to spend from an equipment reserve fund the sum of $200,000.00 as set forth in a resolution adopted by the McKownville Fire District Board of Fire Commissioners on August 6th, 2014 subject to a permissive referendum pursuant to Section 6-g of the General Municipal Law. A copy of the resolution summarized herein is available for public inspection by contacting the secretary of the McKownville Fire District at the firehouse located at 1250 Western Avenue, Albany, New York 12203.
